Pennsylvania's Home Improvement Consumer Protection Act (HICPA), codified at 73 P.S. § 517.1 et seq., establishes crucial requirements for contractors. Understanding these rules protects both contractors and homeowners.

Who Must Comply?

HICPA applies to contractors performing home improvements over $500 in value, including:

  • Renovations and remodeling
  • Additions and structural changes
  • Roofing and siding
  • Plumbing and electrical work
  • HVAC installation and repair
  • Landscaping and hardscaping
  • Swimming pool installation

Exemptions: Work under $500, emergencies (with limitations), and licensed professionals working within their specialty.

Registration Requirements

Contractors must register with the PA Attorney General's office:

  • $50 initial registration fee
  • Annual renewal required
  • Must disclose business information
  • Background check for principals
  • Proof of insurance required

Contract Requirements

Every HICPA-compliant contract MUST include:

1. Consumer Notice A specific notice about homeowner rights, including the right to resolve disputes through the Attorney General's office.

2. Contractor Information - Legal business name - PA registration number - Physical business address (not P.O. Box) - Phone number

3. Project Details - Detailed description of work - All materials to be used - Start and completion dates - Total price and payment schedule

4. Payment Terms - No more than 1/3 as down payment - Progress payments tied to milestones - Final payment due upon completion

5. Change Order Procedures Process for handling modifications to the original scope.

6. Warranty Information Any warranties on workmanship or materials.

Consequences of Non-Compliance

For Contracts: Non-compliant contracts are VOIDABLE at the homeowner's option. This means a homeowner could potentially avoid paying for work already completed.

For Contractors:

  • Civil penalties up to $1,000 per violation
  • Criminal penalties for fraud
  • Loss of ability to enforce contracts
  • Damage to reputation

Emergency Work Exception

HICPA provides limited exceptions for emergency repairs, but contractors must:

  • Document the emergency nature
  • Limit work to immediate safety issues
  • Provide a compliant contract for additional work
  • Follow up with proper documentation
