Demand Letter Best Practices
Be Specific
Clearly state the facts, the legal basis for your claim, and the exact remedy you seek.
Set a Deadline
Give the recipient 10–30 days to respond. State the consequences of non-response.
Stay Professional
Avoid threats, insults, or emotional language. A calm, factual tone is more persuasive.
Letter Types
Breach of Contract
For situations where the other party has failed to perform their obligations under a written or oral agreement.
PA contract law requires proof of a valid agreement, breach, and resulting damages.
Property Damage
For situations where another party has damaged your real or personal property through negligence or intentional conduct.
PA tort law — duty of care, breach, causation, and damages. 2-year statute of limitations (42 Pa.C.S. § 5524).
Consumer Protection (UTPCPL)
For unfair or deceptive business practices — overcharging, false advertising, bait-and-switch, failure to deliver services.
Under the UTPCPL, consumers who prove deceptive conduct may recover actual damages, treble damages (3× actual), and attorney fees.
