Plea Bargaining & ARD

Most criminal cases resolve through plea bargaining rather than trial. Understanding the types of pleas and the ARD (Accelerated Rehabilitative Disposition) program can help you make informed decisions.

Types of Pleas

Guilty

You admit to the charges. A sentence is imposed. A colloquy ensures the plea is knowing, voluntary, and intelligent.

Not Guilty

You deny the charges and the case proceeds to trial. The Commonwealth must prove guilt beyond a reasonable doubt.

Nolo Contendere (No Contest)

You do not admit guilt but accept the conviction. Cannot be used against you in civil proceedings. Requires court approval.

Accelerated Rehabilitative Disposition (ARD)

ARD is a pre-trial intervention program for first-time, non-violent offenders. Successful completion results in dismissal and expungement eligibility. Common for DUI cases under 75 Pa.C.S.A. § 3807.

ARD Requirements

First-time offender (no prior ARD)
Non-violent offense
Complete assigned program (community service, classes)
Pay restitution and program costs
DUI: Highway Safety School & CRN evaluation
DUI: License suspension (30–60 days depending on BAC)
Victim notification and input considered
Successful completion → Charges dismissed + eligible for expungement
