Summary Offenses

Summary offenses are the lowest level of criminal charges in Pennsylvania, heard by a Magisterial District Judge. Maximum penalties: fines up to $$300 and/or up to 90 days imprisonment.

Summary Trial Procedure

Citation or Arrest

Police issue a citation for summary offenses. Some (like harassment) may involve arrest.

MDJ Hearing

Case heard before a Magisterial District Judge. Less formal than a courtroom trial. You may present witnesses and evidence.

Verdict & Sentence

MDJ renders verdict. If convicted, sentence is imposed immediately (fine, costs, or up to 90 days).

Appeal (Pa.R.Crim.P. 460)

You have 30 days to file a Notice of Appeal for a trial de novo in the Court of Common Pleas. The appeal results in a completely new trial as if the summary proceeding never occurred.

Critical 30-Day Deadline

If convicted of a summary offense, you must file your Notice of Appeal within 30 calendar days. Missing this deadline waives your right to a new trial. The appeal bond is typically $500.
