Contractor Disputes Guide
Contractor disputes can involve quality issues, payment disagreements, timeline failures, and consumer protection violations. Here's what you need to know about your rights under Pennsylvania law.
HICPA Protection
The Home Improvement Consumer Protection Act (HICPA, 73 P.S. § 517.1 et seq.) protects homeowners who hire contractors for residential work over $500. Contractors must be registered with the PA Attorney General's office. Contracts must be in writing and include specific provisions.
When Work Is Defective
Document everything: photographs, communications, expert assessments. Give the contractor written notice and a reasonable opportunity to cure (typically 30 days). If they refuse, you may hire another contractor and seek the cost difference.
Payment Disputes
Never pay 100% upfront. PA has no statutory cap on deposits, but HICPA requires the contract to specify the payment schedule. If a contractor demands full payment before starting, that's a red flag. Keep records of all payments.
Filing a Complaint
