Bail & Bond

Pennsylvania law establishes bail types in order of preference, from least restrictive to most. Understanding your bail options can make a significant difference in your case.

Bail Types (Order of Preference)

Under Pa.R.Crim.P. 520–536 and 42 Pa.C.S.A. § 5701

1

ROR (Release on Own Recognizance)

No monetary condition. Defendant promises to appear.

2

Unsecured Bail

Monetary amount set but no payment required unless defendant fails to appear.

3

Nominal Bail

Small monetary amount ($1). Used when some condition is needed but risk is minimal.

4

Percentage Bail

Defendant posts a percentage (typically 10%) of the bail amount.

5

Cash / Surety Bail

Full amount posted in cash or through a bail bondsman.

Bail Modification (Pa.R.Crim.P. 529)

You may file a motion to modify bail at any time by showing changed circumstances. Common grounds include: employment offer, stable housing, community ties, completion of treatment, or reduction in charges. The motion is filed with the Court of Common Pleas and typically scheduled for a hearing within 72 hours.
